Many ancient writers make it necessary that records should be on parchment; but this remark cannot be correct, as many of the Exchequer Records are on paper. An act committed to writing in any of the Queen's Courts is, during the term wherein it is written, alterable - being no record; but that term ended, and the act duly enrolled, it is a record; and, in our common law, no witness can prevail against it. This being the definition of the word Record, it follows that the term is most incorrectly used when applied to parchment deeds, registers, and miscellaneous manuscripts.
