The rise of industrialization coupled with the growth of technology have contributed to creating a complexity to modern warfare that far exceeds the primitive conditions of earlier periods. Defined as the creative use of distributed operations for the purposes of strategy, success at the operational level requires that commanders practice operational art. Although current doctrine recognizes that the operational commander must link theater strategy to tactical operations through operational art, it fails to provide an adequate description of the commander role in campaign planning. Thus, this monograph examines the operational commander’s role in planning and executing a successful campaign. The monograph begins by describing how industrialized societies and technology affected the evolution of warfare thus creating a new medium known as operational art. Next it discusses suitable criteria for determining the commander’s role in operational campaigns followed by an explanation of the campaign analysis model consisting of the operational operating systems described in TRADOC Pam 11-9. The monograph then analyzes three successful campaigns: Field-Marshal Slim as the 14th Army commander in Burma; General MacArthur in the World War II Cartwheel Operation and General Ridgway as the 8th Army commander in Korea.

The idea of military necessity lies at the centre of the law of armed conflict and yet it is less than fully understood. This book analyses which legal limits govern the commander's assessment of military necessity, and argues that military necessity itself is not a limitation. Military necessity calls for a highly discretionary exercise: the assessment. Yet, there is little guidance as to how this discretionary process should be exercised, apart from the notions of 'a reasonable military commander'. A reasonable assessment of 'excessive' civilian losses are presumed to be almost intuitive. Objective standards for determining excessive civilian losses are difficult to identify, particularly when that 'excessiveness' will be understood in relative terms. The perpetual question arises: are civilian losses acceptable if the war can be won? The result is a heavy burden of assessment placed on the shoulders of the military commander.

The degree of inquiry will depend on the nature, validity, and seriousness of the complaint. See reference (b). MANDATORY REFERAL TO NCIS: Reference (c) mandates that certain incidents be referred to NCIS whether occurring on or off base and regardless of civilian investigation involvement. These incidents include: Actual, suspected, or alleged major criminal offenses (punishable under the Uniform Code of Military Justice (UCMJ) by more than 1 year of confinement); Non-combat deaths when the cause of death is not medically attributable to disease or natural causes; Fires or explosions of unknown origin affecting Department of the Navy (DON) property or property under DON control; Theft or loss of ordnance or controlled substances; Disappearance of a command member; All instances of suspected fraud against the government within DON (e.g., theft of government property, bribery, false claims for pay, etc.); actual or suspected acts of espionage, terrorism, sabotage, assassination, and actual, suspected, or attempted defection of DON personnel; Internal security incidents, such as loss, compromise, or suspected compromise of classified information and national security cases; and Suspected sex-related offenses as defined under Articles 120 and 125 of the UCMJ. WHEN NCIS DECLINES TO INVESTIGATE: NCIS may, at its discretion, decline to conduct or continue any investigation, but shall expeditiously inform the effected command. A command may then request assistance from the local base security department or appropriate authority or pursue a command investigation pursuant to reference (a).
