Excerpt from Bismarck's Table-Talk Twenty-eight years! That was a very long time for any Minister to be continuously in harness, struggling with infinitely more than the labours of a Hercules. In some countries - England, for example - the out and in, or see-saw, system of party govern ment has its advantages. But I fear that it would have been unsuited to the particular kind of work which Bismarck was called upon to accomplish. The unity of the Fatherland was a work which demanded unity of purpose and continuity of effort; and Bismarck, alone, perhaps, among all his countrymen, had at once the physical and the mental character istics which fitted him for the performance of this task. Within five-and-twenty years of the fall of the Second Empire, France had well on to forty different Ministries. But from 1862, when Bismarck was called to office, till 1890, when he was dismissed from it, the policy of Prussia and Germany was constantly in the hands of one man. The elder Pitt was the English Bismarck of his day, but he never enjoyed such a continuous spell of opportunity for making his country great and glorious as his Teutonic after-type. In this respect Bismarck's position was unique, just as the products of his power are almost unparalleled. Even in our most casual encounters with strangers--when we are looking at each other, talking, or standing in line--legal systems with elaborate codes, authorized exceptions, and procedures for sanctioning deviance operate with a remarkable degree of success. In this pathbreaking book, Michael Reisman describes how law is an integral and indispensable part of every social interaction. The private sphere or civic order that the liberal state is committed to preserving and in which it tries to refrain from legislating, says Reisman, is not a legal vacuum but the zone of microlaw--some of it just, some unsatisfactory, and some tyrannical. Interweaving numerous real-life examples with a detailed review of the scientific literature of many disciplines, Reisman shows the extent to which microlegal systems function in our own lives. More important, he draws on the criteria of ethics and legal philosophy to demonstrate that, paradoxically, efforts to improve microlaw may threaten the very autonomy of the private sphere that is central to the liberal state.
