Amendment 15B also revises the stock status determination criteria for golden tilefish and specifies commercial/recreational allocations for snowy grouper and red porgy. In addition, NMFS removes language specifying commercial quotas for snowy grouper and red porgy that are no longer in effect and revises sea turtle bycatch mitigation requirements applicable to the Gulf reef fish fishery to add two devices that were inadvertently omitted from a prior rule. The intended effects of this final rule are to provide additional information for, and otherwise improve the effective management of, the South Atlantic snapper-grouper fishery; minimize the impacts on incidentally caught threatened and endangered sea turtles and smalltooth sawfish; and remove outdated language. "The harvest of red snapper was prohibited on January 4, 2010. In 2012, a limited red snapper fishing season was established through an emergency action under the Magnuson-Stevens Fishery Conservation and Management Act. At that time, the South Atlantic Fishery Management Council (South Atlantic Council) determined that some directed harvest could be allowed without compromising the rebuilding of the red snapper stock to target levels, and they saw the limited harvest as an opportunity to collect additional data on red snapper. Similarly, the South Atlantic Council has determined that retention of a limited number of red snapper, beginning in 2013, would not jeopardize the rebuilding of the red snapper stock if the acceptable biological catch (ABC) is not exceeded the previous year. As such, the South Atlantic Council has developed a process with formulas in Amendment 28 where the National Marine Fisheries Service (NMFS) would (1) determine if there would be a fishing season for a particular year and (2) calculate the magnitude of red snapper harvest that might be allowed for that year. If harvest is allowed (when the previous year's mortality level is less than the previous year's ABC), NMFS would announce in the Federal Register the annual catch limit (ACL) as computed by the equation developed in Amendment 28. In years when harvest is allowed, the South Atlantic Council has chosen start dates for the commercial and recreational seasons in the amendment as the second Monday and second Friday in July, respectively. If the fishing seasons do not open exactly on these dates, they would open as close to these dates as possible as stated in the proposed rule. NMFS would also announce the end dates of the recreational season; the commercial harvest would be monitored and the season would be closed when the ACL is projected to be met. Amendment 28 would also implement the following measures during the red snapper openings: (1) a commercial trip limit of 75 pounds gutted weight; (2) a recreational bag limit of one per person per day; and (3) removal of the minimum size limit"--Summary from cover letter.

"A Southeast Data, Assessment, and Review (SEDAR) stock assessment update for black sea bass was completed in 2013, and suggests the annual catch limit (ACL) for this species could be increased based upon the new acceptable biological catch (ABC) levels recommended by the South Atlantic Fishery Management Council's (South Atlantic Council) Scientific and Statistical Committee (SSC). The stock assessment update indicates black sea bass is no longer undergoing overfishing, is not overfished, and the stock is rebuilt. Based on the outcome of the stock assessment update for black sea bass, the SSC applied the approved ABC control rule to black sea bass, revised P* to be 40%, and recommended new ABC values for 2013-2015. At their December 2012 meeting, the South Atlantic Council determined it would be appropriate to modify certain management measures that are currently in place for black sea bass including changes to the commercial and recreational fishing years. The South Atlantic Council is considering modification to black sea bass management measures in Regulatory Amendment 14 to the Fishery Management Plan for the Snapper Grouper Fishery of the South Atlantic Region (Snapper Grouper FMP), which is currently being developed. The South Atlantic Council stated in Section 1.4 of the Comprehensive ACL Amendment that necessary changes to the ABCs, ACLs, annual catch targets (ACT), and accountability measures for snapper grouper species would be made through the framework procedure modified in Amendment 17B to the Snapper Grouper FMP, which is a more rapid process than a plan amendment. "The South Atlantic Fishery Management Council (Council) submitted the subject amendment for review and implementation by the Secretary of Commerce on December 19, 2011. Amendment 20A addresses the commercial sector of the wreckfish component of the snapper-grouper fishery, which is managed under individual transferable quota program. The current total allowable catch for wreckfish for the commercial sector is 2 million pounds. In November 2011, the Council's Scientific and Statistical Committee (SSC) reviewed new data analysis regarding wreckfish, and revised their acceptable biological catch (ABC) recommendation from 250,000 pounds whole weight (ww) to 235,000 pounds ww. The Council reviewed the recommended ABC in December 2011, and passed a motion to concur with the process of adjusting the wreckfish annual catch limit (ACL) to reflect the revised ABC. NOAA Fisheries Service approved the Comprehensive ACL Amendment on January 18, 2012. This revised ACL for wreckfish will be implemented through the final rule for the Comprehensive ACL Amendment on April 16, 2012. Furthermore, 95 percent of the ACL (223,250 pounds ww) will be allocated to the commercial sector for wreckfish. With this reduction in the commercial sector's allowable catch, the annual allocation each wreckfish shareholder will receive under the revised ACL will also be reduced by approximately 89 percent. Thus, active shareholders, captains, crew, and dealers who depend on a certain level of wreckfish production to maintain their operations will be particularly affected by the reduction in the amount of wreckfish the sector may harvest.
