This topical book analyses the main difficulties facing both existing, and candidate, EU countries in the area of Justice and Home Affairs (JHA) on the eve of enlargement. recommendations, which the authors believe are needed to pave the way towards and after enlargement. The policy recommendations reflect the richness and difficulty of the debate as well as the sensitivity of the issues at stake - seeking to strike a balance between security, liberty and justice in the EU at this challenging time. The contributions have been grouped under three main headings, preceded by an overview of the progress and obstacles in the area of JHA. Practical recommendations are presented for each of the three areas: the fundamentals of JHA policies in a post-enlargement EU; scenarios for crime, law and justice in an enlarged European Union; towards an immigration and asylum policy for Europe. Written by academics, high-level practitioners and policymakers, this book will appeal to scholars of European studies and law, European-level policymakers and policy analysts. This book offers an insight into the historical, institutional and topical development of the EU policy in the areas of justice, home affairs and security, well-embedded in a broader international context. The main part of the book, dedicated to the EU, is therefore preceded by a part on relevant cooperation on the Benelux and Schengen levels and followed by a part on cooperation in the areas concerned on Council of Europe, NATO, OSCE, G8, OECD and UN levels. Without a proper understanding of those cooperation levels, the development and functioning of the EU would be hard to fully grasp. Before addressing the actual policy dimension, all parts start with a historical introduction and a sketch of institutional structures and functioning. For students and professionals in criminology, law and political science, and every one interested in European and international criminal policy making this book will prove relevant or insightful.

Terrorism, crime and migration are trans-national challenges. The Hague Programme, adopted in 2004, set out a way forward at the EU level, but the failure of the Constitutional Treaty could mean a reprioritisation is needed. This report looks in detail at several areas (including: policing, criminal justice and judicial cooperation, borders and migration, and safeguarding data) to see which of the possible approaches of practical co-operation, mutual recognition, or harmonisation offer the best way forward. It is the view of the Committee that policy initiatives at EU level should only be pursued if there is a solid evidence-base that they are will make a practical difference to the effectiveness with which common problems are tackled.

This working document offers a conceptual framework for understanding the processes underpinning the external dimension of EU Justice and Home Affairs (ED-JHA). Practically, it defines how the export of JHA principles and norms inform the geopolitical ambitions of the EU, i.e. the use of space for political purposes, or the control and management of people, objects and movement. The author begins by investigating how the ENP reconfigures the ED-JHA, and then goes on to discuss various conceptual stances on governance, specifically institutionalism, constructivism, and policy instruments. To conclude he traces the evolution of this external dimension, emphasising, whenever possible, its continuities and bifurcations. Overall, the aim is to ascertain the extent to which conceptual designs clarify or advance our knowledge of the contents and rationales of the ED-JHA.

The third edition of EU Justice and Home Affairs Law is comprehensively updated and expanded to take account of the major changes introduced by the Treaty of Lisbon and the development of legislation and case-law since the last edition. It includes analysis of the widened jurisdiction of the EU's Court of Justice, the revised rules on the participation of the UK, Ireland and Denmark and relations with non-EU countries in this field, and of the impact of the new framework for human rights law in the EU, including the binding status of the EU's Charter of Fundamental Rights and the EU accession to the ECHR. In the area of immigration and asylum law, this new edition scrutinizes a wide range of issues that include; the development of the EU's border control agency; the adoption of an EU visas code; EU databases (such as the Visa Information System and the second-generation Schengen Information System); the further development of the Common European Asylum System; the EU's Returns Directive; and the Blue Card Directive for the admission of highly-skilled workers. In the area of civil law, this new edition contains an updated overview of recent legislation, including EU rules on conflicts of law, maintenance, payment orders, small claims, and mediation. In decisions about migration, asylum, justice, and order, the transfer of sovereignty from the Member States to the European Union has been one of the most surprising task expansions in the European project. This book sheds light on these extraordinarily dynamic institutional developments and the resulting policy outcomes. Comprising both conceptual and empirical contributions, the book asks whether established theoretical schools of thought still hold true or whether the institutional conditions induced by the Lisbon Treaty have led to new modes of interaction and given weight to rival explanations. (Series: Politik, Gemeinschaft und Gesellschaft in einer globalisierten Welt - Vol. 10)
