It is the heir of investiture alone who can plead the privilege; and it cannot be pleaded to support the fraud of the ancestor, nor to oppose the MINOE 180 MOBILIA effect of the ancestor's obligation, nor in opposition to a minor suing for reduction on the head of minority and lesion." (Bell's Diet., v. Minor.) Placitare signifies to be a party to a suit, from placitum a vocable of the middle ages for suit or process. Ersk., B. 1, T. 7, 43. Minor tenetur in quantum locupletior factus--A minor is bound to the extent to which he has been enriched or benefited. A minor on attaining majority has the privilege of reducing any deed granted, or obligation undertaken, and of repudiating any transaction entered into with or for him, if the same has been to his lesion. This would be directly opposed to the maxim, Nemo debet ex alieno damno huerari. The measure, therefore, of the minor's benefit or lesion is the measure of his privilege. If he has been altogether benefited by the transaction, his privilege is altogether excluded, but if he has suffered lesion, he can plead his privilege to the effect of being restored against that which caused it, and to the extent of the injury inflicted. Mitiores poena nobis semper placuere---Laterally, lighter punishments are always more pleasing to us; i. e., it is more pleasing to inflict a light than a severe punishment. Stair, B. 2, T. 11, 31.
