An attempt has been made to make a comparative analysis of the constitution-making processes of four countries: the U.S.A. and France, representing the democracies in the West; and Turkey and Japan, representing Asia. The second chapter is devoted to the constitutional discussions in India during the period 1919-1935. The third and fourth chapters analyse the constitutional and political ideas put forth by Hindu and Muslim thinkers. Although the Hindu and Muslim leaders concentrated on the ultimate goal of political freedom from British rule, this study considers in some detail to what extent there was coherent thinking on the system of government to be established in independent India and Pakistan. The fifth and sixth chapters deal with constitution-making in independent India and Pakistan. The final chapter tries to analyse the major influences which shaped constitution-making in both India and Pakistan.

Yet, Rau’s ideas and his voice have largely been forgotten today. By examining Rau’s constitutional ideas and following their trajectory in late colonial Indian politics, this book shows how the process of the making of the Indian constitution was actually never separated from the politics of conflict that dominated this period. This book demonstrates that it is only by foregrounding this political history that we can simultaneously remember Rau’s critical contributions as well as understand why he was forgotten in the first place.

The Constitution of India adopted on November 26, 1949, became operative on January 26, 1950. It provides for two layers of Government, one at the Central level, and the other at the level of the States. A federal polity of this kind requires division of powers and responsibilities between the Centre and the States. Hence, the Constitution describes in detail the legislative powers and functions of the two tiers of Government. It is the fountain-head of all legislations. India, with a population of more than one billion, is the world?s largest democracy. Indian polity consists of three main branches, namely the executive, legislature and the judiciary along with subsidiary branches like political parties, statutory institutions etc. This book presents a comprehensive description and analysis of the constitution, system of government and dynamics of politics in India, a geographically and demographically vast country inhabited by people professing different religions, speaking a variety of languages and adhering to diverse socio-cultural ethos.
