Marine accidents can occur at any time and everywhere in the world, resulting in loss of life, property, environment and reputation of the companies involved. Preventing accidents and establishing a safer world without accidents is an important agenda for the maritime industry. Since the enforcement of the International Safety Management Code in 1998, companies have taken various kinds of measures to prevent accidents. Unfortunately, measures have been undertaken in a disorganized manner, and have not been effective. Experts of risk management, the safety management system, and accident models have each undertaken accident preventive measures within the scope of their specific fields, but have not looked beyond the realm of their own fields. This book discusses systematic accident prevention by integrating multi-disciplinary expertise based on academic research, the quality management system which has already proved its effectiveness in other fields, and findings of the author’s research. In systematic accident prevention, the weaknesses of a system within which accidents and incidents have occurred are viewed by combining scientific accident investigation data based on the International Maritime Organization model and the accident model. The nature of every type of marine accident, such as collisions, groundings, occupational casualties, etc., are derived by combining the accident model and statistical data. System weaknesses are rectified by the risk reduction method of risk management, and the rectified performance is incorporated in improvement in the system by the PDCA cycle, which is the core of the Safety Management System. We can see the weakness in the system and reduce the number of accidents and incidents while utilizing limited resources optimally to prevent accidents and incidents.

Water supports our planet and its vast resources need to be fully utilized to benefit human activities and his environment in a sustainable manner, most of inland water resources has been under utilised and under maintained. Maritime industry has made use of the ocean in a more much responsible manner for cross continental transportation of good. There are currently dire needs to find sensitive ways to mitigate challenge of global warming, climate changes and its associated impact, especially within the coastline. Various research works has proven that Inland Water Transportation represents the cleanest mode of transportation. Its use could reduce and mitigate carbon footage and other Green House Gases. Past system design and operation has followed conventional method. System has been addressed through reactive behaviour that has put system on probable risk and consequence in oblivion. Likewise, complexity of sustainable water transportation development demand design and operation that require careful evaluation which can be achieved by employing proactive method. That considers holistic system analysis approach. It has become important to address system associated risk, reliability and their life cycle through assessment of accident and pollution prevention, protection, control principle. Ageing, uncertainty and operational factors are also important system variables that need to be incorporated in risk close loop system. This book account for modelling of proactive technik and application of a top down risk and reliability based design that identifies assess, analyses and employ sustainability equity comparison leading to generic safety and environmental risk reliability model (SERM). SERM is a decision support system tool developed at University Technology Malaysia for the development of efficient and sustainable Inland Water Transportation System (IWT).

The United Nations Convention on the Law of the Sea of 10 December 1982 entered into force on 16 November 1994. Since this date a single binding instrument has regulated the rights and duties of States at sea and regarding the sea. New concepts, such as the exclusive economic zone, archipelagic waters, transit passage through straits, and the International Seabed Area, are now fully recognized. The fifteen member States of the European Union are a significant sample for analyzing the practice of States, or at least that of the Western industrialized States, as regards the law of the sea. They include major and small maritime powers, coastal and land-locked States, States with coasts on the Atlantic Ocean and States with coasts on semi-enclosed seas such as the Baltic and the Mediterranean, States with and without involvement in deep seabed mining and States with different interests as regards fisheries. The fact that they all belong to the European Union is a very important common feature, which amply justifies the choice made to study them together. The book's aim is to give, through essays prepared by well-known specialists, a detailed survey of the attitudes and practice concerning the law of the sea of the member States of the European Union and of the European Community as such. The common positions of the member States and the results of their coordinated action also emerge from these essays. The fact that the member States and the European Community are now actively engaged in the process of becoming parties to the Law of the Sea Convention is certainly a major contribution to the consolidation of the Convention as a universal instrument, or at least as an instrument widely ratified by States of all continents and economic and political interests.
