A Chinese judge will always modify the rigour of the law if local usage differs from it; and a Chinese will invariably be in favour of fi 3 ch'ing ii (the application of special circumstances) in each case. In this sense the term family law is to be understood not merely as a statement of the Chinese family laws (leges) but including also general usages, which will have to enter largely into a future codification of the Chinese law, especially private law.
