Excerpt from The Preservation of Open Spaces, and of Footpaths and Other Rights of Way: A Practical Treatise on the Law of the Subject The object of this work is to furnish those who are interested in preserving the open lands of the country, and the footpaths and other means by which rural England may be enjoyed, with a sketch of the law by which such enjoyment is secured and regulated. Some care has been taken to avoid the unnecessary use of technical terms, and thus to make the book intelligible to laymen, without, it is hoped, sacrificing accuracy and precision of language. Common rights have been the subject of many legal treatises, and the Lectures of the late Mr. Joshua Williams deal exhaustively with the topic from an abstract point of view. This volume treats rather of the several descriptions of land which are subject to common rights, and of those rights as the means by which such lands may be protected from inclosure. Thus, it has not been thought desirable to deal elaborately with such questions as that of surcharge between commoner and commoner, or those arising upon the partition of common lands under a Parliamentary inclosure.
