Since the International Civil Aviation Convention was concluded in 1944,a great deal has changed in the world of international aviation. Deregulation was introduced in the United States in 1978, the historic Single European Aviation Market was created in 1993, and now the Single Aviation Market of Australia and New Zealand has also been created. Liberalisation and competition has brought unprecedented choice to air transport users. There are no signs that this trend will go into reverse. Many of these efforts have taken place in the context of regional aviation markets from Europe to South America to Africa and across to Asia. Together, they offer a different perspective to the search for a new juridical order in the regulation of international aviation. This book seeks to add to this search. It examines developments in Australasia and argues that Australia, New Zealand and the Single Aviation Market they have established have much to offer the continuing campaign to re-write the constitution and conventions of international aviation.

Over the past few decades, the traditional aviation market has seen significant developments.Traditional “legacy“ carriers have been challenged by new no/low-frills, low cost carriers. While these new airlines have a relatively long history in North America, more recently they successively emerged in markets such as Europe, Asia, Oceania and Africa. The business model of low cost carriers has revolutionized air travel, and both media and academics paid ample attention to these in America and Europe. However, academic literature pertaining to the development of low cost carriers in Australia and New Zealand is scarce. Thus, this paper offers a brief history of low cost carriers in this region, and compares the business models of low cost carriers currently operating in and between Australia and New Zealand. The paper concludes that low cost carriers in this region differ from American and European low cost carriers, in part due to the geography of the countries. The main differences are the levels of in-flight service, and the fact that Australian and New Zealand low cost carriers operate on longer distances, such as coast-to- coast domestic flights in Australia, trans-Tasman flights, and flights to the South Pacific islands, and increasingly to Asia.

Australian bilateral air services agreements, like those all around the world, invariably contain an airline nationality clause. Most such clauses restrict designation to airlines “substantially owned and effectively controlled” by the state of designation and/or its nationals. A key feature of the bilateral regulatory framework, ownership and control clauses work to restrict the benefit of an air services agreement to the signatory states and lock out third parties. Uncontroversial and rarely problematic in the days of the government-owned flag carrier, the requirement is now a serious obstacle to meaningful liberalisation in the commercial aviation sector.The free flow of capital is axiomatic of globalisation. Commercial decisions can be taken with relative freedom from artificial nationality distinctions. Rationalisation along efficiency lines, accordingly, is the norm in global markets. The airline business, however, is treated differently. Ownership and control restrictions isolate the airlines and curtail the ability to access capital, consolidate across borders and establish in new markets. Prospective efficiency gains are forgone. Many suggest, on reasonable grounds, that the future health and prosperity of the industry and the broader marketplace is dependent on relaxation of these restrictions. Commercial aviation, they posit, should be treated “just like any other business.” Australia considers itself at the forefront of liberalisation initiatives. It is party to 3 "open skies" agreements, one of which comprises the Single Aviation Market with New Zealand, and is presently, it is reported, negotiating a further substantive agreement with the EU. Foreign ownership restrictions for Australian airlines have been progressively reduced and, most notably, 100% foreign ownership is permitted for domestic airlines. However, like many other nations, Australia is still bound by traditional ownership and control restrictions in many of its approximately 70 bilateral agreements. Reform on a point has been slow and, as this paper will argue, further action is needed.

Taking Stock of Air Liberalization is about Technology, Economy, and Policy (TEP) in the airline industry. Ten years ago, the practical collaboration was begun of bringing together people who belonged to the complementary streams of economic analysis and policy analysis presented int his book. During this time, we opened discussions on the relationship between transportation technology, transportation economics and transportation policy under the general auspices of the Canadian Royal Commission on National Passenger Transportation. Working over a 40-month period (1989-1992), this Commission took stock of transportation and produced an up-to-date `État de la question' and policy framework (Hyndman, et al, 1992). Clearly, the project committee's discussions on air policy, over the period 1995-1997 (see Chapter 8), outlined the possibilities for a mechanism to understand the differences about the desirability of air liberalisation, as well as the possible TEP interactions in this area. This led to an exploratory first formulation and computer programme (HLB, 1997) incorporating the approach outlined in Chapter 15. A joint celebration of the CRT's 25th birthday and Transport Canada's 60th birthday seemed appropriate to bring together the various streams. Part I of Taking Stock of Air Liberalization looks at the record, and Part II focuses on specific impacts of policies. Policy formulation (Part III) and the required tools (Part IV - Modelling Demand) are also discussed in this context. The book ends with perspectives in Part V - The Future Market Structure and Public Policy. The competition among airlines is rapidly spreading to the competition among airports, and the difficult regulation of these strategic spatial monopolies (which is introduced in Chapter 13) is now attracting research activity. The next discussion in the airline industry will be the role of airports.
